Fort Hood Execution Livestream: Carr Defers to Hegseth

The Fort Hood execution livestream plan has pulled the Federal Communications Commission (FCC) into an unusual debate. FCC chair Brendan Carr says the agency has no role in the matter. He added that he will defer to Defense Secretary Pete Hegseth. The execution of Nidal Malik Hasan is currently planned for Dec. 3.

    What Hegseth Actually Announced

Hegseth said he wants to ensure “that people are able to watch” the firing squad execution of Hasan. The announcement came with Trump’s authorization. However, Hegseth did not explain what that means in practice.

The Pentagon could stream the event on its own online channels. Alternatively, Hegseth could expect TV networks to carry it. No official has settled that question yet.

Trump has not clarified it either. He told reporters on Friday that he does not care how Hasan goes “as long as he goes.” He did not specifically endorse a livestream.

What Carr Said About the FCC’s Role

Carr spoke on CNBC on Friday. He said he had seen no sign that the execution would air on broadcast TV. Therefore, he sees no role for the FCC “one way or the other.”

He also praised Hegseth’s handling of the rules that apply to the Department of War. In his words, the FCC will defer to the secretary on how to proceed.

The stance stands out because of Carr’s record. He has threatened to terminate broadcast licenses over unfavorable coverage of the war with Iran. Critics see a sharp contrast between that approach and his hands-off response here.

How Much Power Does the FCC Have Over Content?

The FCC regulates spectrum, but its authority over what airs is limited. Its main tools include:

    • The equal opportunity rule: Stations that give airtime to one candidate must offer comparable access to rivals. The agency has rarely enforced it.
    • Sponsorship disclosure: Broadcasters must reveal who pays for certain content.
    • Obscenity and indecency limits: The FCC can fine stations that air such material. After 2012, however, a Supreme Court decision narrowed its indecency policy, and enforcement has been fairly restrained since then.
    • News distortion: The agency has claimed this power since 1949, based on its “public interest” mandate. Congress never explicitly approved it, and the FCC invoked it only eight times before recently.

Can Anyone Force Stations to Air It?

Not directly. The United States has no state-owned broadcaster except Voice of America. That network mainly targets foreign audiences and is barely operational.

As a result, Trump, Hegseth and Carr cannot order other stations to carry the footage. The decision would rest with network executives and local station managers. Some might refuse on moral grounds, even without any threat of fines.

Why a Fort Hood Execution Livestream Would Be Unprecedented

Hasan carried out the 2009 terror attack at Fort Hood. He killed 13 unarmed people and wounded 32 others. He did not defend himself at trial. He has also suggested that execution would let him become a martyr.

The last public state execution in the U.S. took place in 1936. A Kentucky hanging drew a crowd of up to 20,000 people. A broadcast would go further than that, since no American execution has ever aired.

Even governments known for public executions rarely release video of them. According to the original report, this includes Iran, North Korea and Saudi Arabia.

Political Reaction and What Comes Next

The announcement drew criticism from a few Republicans in Congress. Vice President JD Vance said he hopes people remember Hasan’s crimes. Still, he said he will not watch any livestream.

The plan could also change. Trump’s comments left room for the administration to back away from a public showing. Meanwhile, the date falls about a month after Election Day. If Democrats win the House or Senate, they would likely target the livestream plan.
